If you have an agreement with the hospital or doctor, whereby they agree to the payment plan, then so long as you honor your obligations under that plan, they cannot take legal action against you.
However, if there is no agreement and you are simply sending in whatever you can, they may take action: you cannot determine for them what payment schedule is acceptable, and the fact that you are paying something does not, without an agreement, preclude them from taking action for the balance.
