What to do if I did not receive my final paycheck within the legal timeframe?

My state law provides thatif you are terminated from a job they have 7 days or the next pay period whichever is sooner to give you your final paycheck. If my employer terminated me and didn’t give me my final check in the 7 day period but rather in the next pay period, which was 10 days after my termination, what are there penalties? And what course of action should I take, if any?

As you probably know, the statute says you are entitled to treble (triple) damages, but since you have been paid, it is unlikely a court would impose such a strict penalty against your former employer.  You probably should resist the urge to take action on this.
