If you leave the state with out an "intent to return" then it is a possibility. You can not interfere with the parental rights of her father. I say that here assuming that parentage has been established and even possibly a custody and visitation order put in effect. If you were never married and the above is not in place then you are the only legal guardian of the child. But I would speak with a lawyer before you move.
