You do not necessarily need an attorney for any legal transaction.  But given the potential complexity of the matter I would not enter in to any agreement without first paying some one to read it and to advise me of my rights in the situation.  If there are children involved then you need to file certain documents with the court as to support and custody that you can not get around.  If you can agree on the custody issues and the division of your marital assets (do you even know which assets are marital and which are not?) then you are ahead of the game (child support is generally an equation that numbers are plugged in to).  Good luck to you both.
