I was involved in a car accident with a guy driving a rental car (hertz). The accident happened 5 days ago and Hertz is still "investigating" the accident....The driver was at fault and was issued a ticket....meanwhile we have been without a car to get to and from work or to get my kids to and from school/daycare. I went to the ER because of headaches and soreness. The problem is that I do not have health insurance right now and the ER visit will probably cost about $1000. If you combine the medical bills with the lost wages I will be in the hole over $2000. Is Hertz obligated to pay this money back to me? Will they fight it and force me to get an attorney?

If you have an auto accident and the other party is responsible, then the other insurance company is obligated to pay for the repiars to your car, your medical expenses and, if you have to rent a car, the cost of the rental car.If your insurance company provides coverage for medical payments and/or rental car coverage, you should submit a claim through your insurance company. They will go after Hert for reimbursement, and it allows you to have some of your expenses paid before the other insurance company determines the loss.If you don’t have coverage, then you should talk to the adjuster and get authorization for a rental car and to ask how you should submit your medical payments. They may not be willing to settle the medical portion until all bills are submitted.If the other party was issued a ticket, the result of the settlement of the claim should resolve in your favor. If so you will be reimbursed for all expenses regarding the accident.
