If you have an auto accident and are charged with a DUI, the accident is still covered presuming you have physical damage coverage, or collision coverage on the car that was involved.The policy covers your car for the actual cash value of the car at the time of the loss. This may not be enough to pay off your car loan. However, if the insurance company is refusing to pay anything to the lienholder, that does not seem right. If you have an agent, speak with them to see if there is an exclusion in the policy for refusal to pay if there is a DUI involved in an accident. If there is no such exclusion ask the agent to assist. If you don’t have an agent, ask for a supervisor in the claims department to see if they will explain the refusal to pay anything on the car. If nothing is resolved, you should contact the Dept of Insurance to have them investigate this claim.
