Is it legal if my employer is forcing me to sign a non-compete agreement after I have worked for them for over 3 years?

They said if i do not sign it, it would be considered my resignation. Is this legal?

Yes, an employer can do this. In exchange for your continued employment, you need to sign this agreement if you want to remain employed. Absent some form of legally actionable discrimination or an employment or union agreement to the contrary, an employer can set the conditions of the workplace much as it sees fit. This is known as "at will" work. Bottom line, if you want to keep your job, you'll need to execute the non-compete.
