I am trying to rent a condo and was arrested 5 years ago for simple battery but was never charged. Can the HOA deny me from renting based off of this?

If the HOA rules give the HOA discretion over who may rent and/or a right of approval over rentals, then they could deny or refuse you for this reason: there is no law protecting your right to rent if you have any sort of a criminal record, and people can refuse to rent to you for this reason.
