It's hard to say.  There are so many variables that go into the amount of the settlement.  For example, many times insurance companies claim that disc damage is pre-existing.   They may claim that the impact was not severe enough to cause such an injury.  They may also claim that although there is a herniation, it is not causing any problems.  I realize that you may have medical records and doctors saying the opposite.  I'm just telling you what many insurance companies argue.  Also, the amount of your medical bills, how long you treated, whether the doctor thinks you may need future surgery, whether it will affect you ability to perform your job, and many other variables come into play.  I would be happy to speak to on the phone, without charge, to better answer your questions.  (954) 735-0000 x 1.   -- Richard Sachs
