What s the best way to get a refund for a purchase?
I have paid $5,300 to a person for the items. And it has been more then a month he has not shipped the items and he is making excuses and not returning the money. What is the best legal way of getting my money back?

You can sue for breach of contract based on the defendant's failure to ship the item or refund your money. Depending on the maximum amount you can recover in your state's Small Claims Court, you may be able to file your lawsuit in Small Claims Court. Your damages (the amount of compensation you are seeking in your lawsuit) would be the $5300 plus court costs. Court costs would include the court filing fee and process server fee.
