What to doif Iresigned from my job and my old employer has not paid my commission owed from 2 months prior to my leaving?

I resigned from my job this month and my old employer has not paid my commission owed from 2 months before I left. They “forgot” to pay me for my commission but I reached my goal and then handed in my resignation giving the appropriate amount of notice. In my final pay (today) they did not pay me the back dated amount owing, even though until the day I left they said they would.

If an employer does not pay an employee any compensation owed for work done--incluing paying any commissions earned, as per the terms or conditions under which conditions were accrued and paid--the employee may sue the employer for the money. If you have good evidence of how mcuh they owe you, so that the case should be straightforward, you may wish to consider acting as your own attorney in small claims court (assuming the amount owed is under the threshhold for small claims cases in your jurisdiction), which will let you save on lawyer fees.
