Going to court, or settling out of court, for an asbestos lawsuit can take any amount of time, depending on the specific details of the case. In many situations, you won’t be able to tell how long your case will take until you know whether or not the other side is willing to settle, or if you will have to go to trial. Obviously a trial will take longer than a settlement would.
The Asbestos Lawsuit Process
In general, the first several steps of an asbestos lawsuit will involve getting a lawyer and providing them the information they require, as well as the filing of the lawsuit itself. If your lawyer is available and you are ready to move on this, you could finish this initial process within a week or two. Once the papers are filed, it will be up to the other side to respond. You may want to give them a deadline, such as ten days, so that they don’t drag their feet too long in responding.
- If they offer to settle, it will become a situation in which your lawyer goes back and forth with their lawyers in order to (hopefully) agree on a solution that satisfies both sides. This could go on for quite some time depending on 1) how flexible they are, and 2) how flexible you are.
- If you absolutely cannot reach a settlement after a couple of offers go back and forth, your lawyer will probably recommend a trial, in which case you can expect several months, or even a couple of years, to elapse before completion. In many areas, courts are backed up with asbestos lawsuits and litigation and it can take a long time before the case even gets to trial in the first place. Once it does, you still have to go through the process of both sides presenting their case and the final judgment award, if you win.
