Bayer Healthcare Pharmaceutical is currently defending 10,000 Yaz lawsuits filed in federal and state courts and may have to settle upwards of 25,000 lawsuits in the very near future. Here’s an update on the litigation and what you can do if you’ve been injured.

Yaz Lawsuits: 10,000 Cases Pending

Yaz and Yasmin are birth control pills which contain drospirenone & ethinyl estradiol (estrogen) which can dangerously increase potassium levels and result in blood clots, heart attacks, strokes, kidney and liver damage and much, much more.

It is estimated that nearly 10,000 lawsuits have been filed against German-based Bayer Healthcare by women who have been injured or by family members in cases where women have died. These Yaz lawsuits allege that Bayer was more concerned with market share than it was about consumer safety, knew about the drugs’ risks, failed to warn consumers and used questionable advertising campaigns which led women to believe that the drugs alleviated the symptoms of PMS (premenstrual syndrome) and controlled acne.

Yaz Litigation: Federal MDL & State Cases Pending

Yaz litigation is currently pending in both federal and state courts – mainly New Jersey and Pennsylvania. Since many of the allegations against Bayer are similar, lawsuits filed in federal court have been consolidated into an MDL (Multidistrict Litigation)- a procedure which allows civil lawsuits with common questions of fact to be consolidated for pretrial proceedings in front of one judge for the convenience of the plaintiffs and witnesses and to avoid conflicting rulings.

The Judicial Panel on MultiDistrict Litigation assigned the MDL (MDL-2100) to Chief Judge David R. Herndron in the U.S. District Court for the Southern District of Illinois. In January 2012, Judge Herndron postponed the first test case (also known as a bellwether case) indefinitely and ordered mediation for the entire Yaz and Yasmin MDL litigation to see whether some or all of the cases can be settled.

Yaz Lawyers Say More Cases Being Filed Every Day

Even with 10,000 lawsuits pending, Yaz injury lawyers say that more and more lawsuits are being filed every day against Bayer for Yaz and Yasmin and other pharmaceutical companies which manufacture generic versions of the drug – whose side effects include blood clots, heart attacks, strokes and more.

The situation is reportedly becoming more politically charged as well. Consumer advocacy groups continue to urge Congress to pull these “fourth generation” birth control pillsoff the market based on FDA (U.S. Food & Drug Administration) black box warnings, FDA warnings to Bayer about questionable marketing and manufacturing practices, damaging European clinical studies – and of course, the thousands and thousands of women who have been injured.
