Yes, as a general rule they would. To protect yourself, you need to get a formal separation agreement executed which would cover such a situation. A divorce would also accomplish this but a seaparation agreement could be signed off on more quickly than the time it would take to finalize a divorce.

Note: In the event of your death, you legal psouse would also have certain rights to your estate, whether or not you had a Will providing otherwise.
