When someone dies without a Will, they are said to have died "intestate". This means that the intestacy laws of the state in which they were domiciled when they passed will control the distribution of their estate. The exact percentages vary from state-to-state. In PA, typically such an estate is split between the surviving spouse, if any, and the deceased's children. Since the surviving spouse is a steparent, the distribution is: his spouse inherits 1/2 of his intestate property and you (and your siblings, if any) inherit the other half.
