Will I have to do jail time for a first time DUI misdemeanor accident if no one was injured and there was no property damage?

I hit a tree. Can’t prove how fast I was going. I was the only person in the vehicle and the tree I hit was not damaged.

Jail time varies by State and Judge on 1st offense DUI charges. Obviously penalties may stiffen if an accident was involved, but in Michigan first offenders are generally given probation. My avice is to contact a criminal defense attorney in your area who is familiar with the sentences handed out by the judge you will go before.
