This may be illegal, and an employee who is treated worse because of his or her marital status may have a viable legal claim. That is because your state prohibits discrimination (or differential treatment) in employment on the basis of marital status. An employee discriminated against on this basis could contact your state equal/civil rights agency to file a complaint.
