He supposenly is a con artist .

If he misrepresented to you his ability to rent to you and give you possession, you could sue him to recover the money you paid and/or to terminate or rescind a written lease (if there is any). Note that if you have no written lease (so you are a month-to-month) tenant, only paid him for month, and end up being able to stay there that month, you might not be able to recover anything since in that case, you have not in fact been damaged--you paid for a month, you got a month's residence.
