Is it legal for an ER to do a drug test without my knowledge or consent and then give it to my doctor’s office without permission?
I was informed that I gave a possitive UA for marijuana and I do have a mmj card which is valid. I was never told that a test was even performed nor was I asked to give one.

Under the laws of all states in this country it is standard protocol for an emergency room technician to do a drug test upon a patient for the simple fact to rule out there is no drug overdose causing a problem. For no drug testing to occur such would be below the standard of care for an emergency room technician.
