This is directed to J.M.A. regarding his answer for motion to suppress/dismiss. The light is not an extra & is required to be in working order by law

The mechanics weren’t hired they merely inspected the light and its wiring for possible faults. They both found it flawless. I’ve never been in ANY kind of trouble with the law before. But the driver of my truck ( for less than 4 blocks) had a suspended drivers license that I wasn’t aware of. He had a history and a search ensued. The driver was cuffed and put in a police car. I was not worried because there should have been nothing illegal in my truck. They found a pipe wrapped in a sock in my passenger side door pocket. I did not put it there & it was not mine!! 2 be cont …….??

Thanks for providingthe info:  It sounds like the police may have improperly profiled the driver.  If it was your car and your license was in good standing, the police shouldnt have pulled the car over (i.e. running the license plates).  If the story is that they saw the light out, and your mechanic's say that they were in perfect working condition, then you have a dispute of fact that the judge will have to decide by hearing the mechanic's testimony in court.  Will the mechanic come to help you?  The fact that you have no record is a good thing; however, the state will say that there is a first for everything.  you need to hire a lawyer and spend some money to try to suppress the evidence found.  However, like i said before, you want to find out, since you  have no prior record, if this case can be dismissed by you doing some community service of taking so type of drug education classes.  Will the driver of the car say the drugs were his?
