What can I do if someone else is using my business name as their domain name and making a nominal amount of money from advertising?

When I register my business with the state and trademark the name, is that person still allowed to use that domain name? We would like to use the domain name for our website, but he won’t even respond to our requests to buy it from him. How would that work?
