What are our rights if our 6 month old son’s femur was fractured at daycare?
It is not a spiral fracture but and impact fracture at the bottom of his femur. They say in their accident report that the incident occurred at 2:35 pm. and we were not notified until 3:22 pm. When they notified us they said “the teacher tripped over a blanket and fell while holding him. Our son landed on the teacher and bumped his right knee. He is OK but he was a bit shaken up”. We took him to the ER and after bringing him home and seeing how uncomfortable he was. We found out it was fractured and he also had bruising on his chin, lip and mouth. What should we do?
