My tenant won’t pick up his belongings and no longer pays rent or occupies the property.

So let me understand here. The tenant is really still the tenant and should be paying the rent, correct? And they will not execute any documents mutually dissolving the lease? Then I think that you have no option here but to start legal eviction proceeding against them. Other wise you really can not legally enter the premises or do anything with the property that they left behind. If you do and if you did then you could be held liable TO THEM, believe it or not. If you do anything with their things you could be guilty of conversion or even theft. Please get legal help with all of this and sue them for the remainder of the lease agreement. Good luck.
