What can I expect out of a divorce?

We have been married 21 years. Then 2 and 1/2 years ago he started having an affair. She moved here about 8 months ago. I realize that this is not going to stop. I want a divorce. We live in a house that his parent’s own. We have 3 daughters ages 22, 20 and 15. I am a stay at home mom that babysits for $200 a week. That is my only income. He brings home about $3250 monthly. Because of our lack of money he has not moved out but sleeps in our oldest daughter’s bedroom. She moved out almost 2 years ago. Our youngest does not want to leave our home. We both agree that she should not have to. We also both agree that I should stay here with her.

I am so sorry for your situation. You really need to speak with some one about the matter. Try legal aid or legal services in your area. Do you have a lease for the house? What is the legal status of your living situation?  I understand that they own it but do you pay rent?  If you have agreed to your exclusive possession of the home then it needs to be in writing and it needs to be a legal tenancy. It is good that he is on board with it but if his parent own it then it could be an issue later on. You will receive child support for the 15 year old.  You should receive spousal support as well given the length of the marriage at least for a short time to get yourself back on your feet.  Remember to think about health insurance for the kids (they can be on longer now if they fit the criteria) and if you are helping to pay for their education think about that as well because he will not have to by law once they reach 18. Good luck to you.
