If my husband’s co-defendant was sentenced to 15 months, do they have to sentence him the same?

My husband and his sister got charged with the same charge as co-defendants. They got sentenced to probation. She violated a year ago and got 15 months. My husband has been violated now. Does the judge have to sentence him the same. She was the primary suspect.
