If my husband has court for a misdemeanor offense and has a $1,000 fine, were he to pay this fine before court would this keep him from doing jail time?

Whether or not payment of the fine prior to the court appearance would keep your husband out of jail depends on the discretion of the judge and on the language in the statute for the particular misdemeanor.  The language in the statute may say the violation is a fine of ________ and /or imprisonment for a period of _______.
Although payment of the fine prior to court would be considered favorably by the judge, it is still the discretion of the judge whether or not to impose a jail sentence.
