If my husband has been sentenced to 20 months state jail time but he can get out early for good behavior, what does this entail?
He had an arrest back 12 years ago and was incarcerated in a state jail for 8-9 months before they dismissed the case. Can that time be applied to this since he was licked up for so long for something he didn’t do?

Hello. Whether time to be served for a prior conviction has been applied concurrent to a later conviction depends on what the sentencing order states. You state your spouse never committed some prior crime, so I urge you privately to have an attorney evaluate the matter and provide you with legal advice. Wrongful convictions can and do occur.
