In New York, so long as the person who is receiving alcoholic beverages is over the age of 21 years, it is not illegal from a criminal standpoint to serve that person beer even if he or she is intoxicated. The issue becomes one of civil liability if that person leaves the home under the influence of alcohol and gets involved in a mishap.
