It would be advisable for you to ask the attorney prior to disclosing any confidential information during your free consultation. 

If an attorney / client relationship is established by the attorney taking your case and you signing a retainer agreement, the attorney / client privilege of confidentiality of communications is clearly applicable. 

If you go for a free consultation and the attorney does not take your case, no attorney/ client relationship has been established.  If there isn't any attorney/client relationship, there isn't any attorney/client privilege of confidentiality of communications.
