The issue is whether or not the item you were caught shoplifting has a value warranting that the crime against you be filed as a felony. The worst part is that the arrest most likely is a violation of your felony probation and if convicted on the new charge there could be enhancements placed as to you due to the prior felony conviction.

If you do not have a criminal defense attorney representing you in this matter, I suggest that you retain one. If convicted, most likely you will be sentenced to jail time since this is your second offense. Worse yet, depending upon the number of felony convictions that you have, you could be sentenced for a significant period of time if convicted on the new charge.
