Since the driver has auto insurance in his/her name, the driver will be sued if the amount of auto insurance is inadequate to settle the case.  In order to have your own auto insurance policy, the driver must be at least 18 and that age is considered to be an adult.  If a lawsuit is filed against you, your auto insurance company will provide you with an attorney at no cost to you.
