And, if so, can someone get in trouble for having those written off?

When a person passes with a Will and the Will is probated, creditors have a certain time period to make a claim against the estate for money owed. If a claim is timely filed and accepted, the estate is required to pay off the bills from its assets which could require the selling of assets of the estate.
