You would have a personal injury claim and a worker's comp claim.  Before you decide to file either, you should visit with a personal injury or worker's comp attorney to see which will be the most help for your situation.  Usually, you can obtain a higher remedy through a personal injury claim.  However, if your defendant is judgment proof (i.e. has no way to pay the claim), then you may want to stick with a comp claim.  A good personal injury attorney will walk you through both options to see what your short term and long term objectives are.
