You need to make sure you were not given Miranda rights while you were hospital. If you did not suffer head injuries and remember everything that occurred, then yes, your Miranda rights being violated is an issue, especially if you gave a confession or were not given a chance to meet with an attorney if you asked for one. Talk to a criminal defense attorney to see if the arrest and charges can be thrown out based on the technical violation.
