What can I do if I own 1/2 duplex and the roof is in need of repair but my neighbor refuses to pay their share and the roofers will only replace if both sides agree?

Good question. I would have a face to face meeting with the other owner as to the need for the repair of the roof of the duplex and follow up with a letter to that effect seeking contribution. If the other neighbor refuses to pay his or her share for the repairs, then you either hold off on the repairs or advise the other owner that you will go ahead with the repairs and surcharge him or her one half of the costs assuming the roofer is willing to make the repairs without a joint agreement of the owners.

If there is no agreement for the repairs, then you need to consult with a real estate attorney as to how to proceed. Possibly there may be a recorded document on the duplex requiring cooperation between the joint owners for repairs of the structure?
