I’m a 62 year old school teacher – never any problems. On the way to school at 7:30 am a lady thought I cut her off. She went around me and stopped in the middle of the road. I slightly bumped her, no damage to either car. She called 911. Police gave me sobriety tests and then took me to hospital for blood tests. I took prescription drugs night before, as I have for the past year. My doctor can vouch for me. I’ve been charged with DUI. What do I do now? Should I speak with a DUI attorney? I’m in Fresno, CA.

If you have been charged with driving under the influence of alcohol or a controlled substance, this is a very serious matter. Penalties if convicted could include jail, monetary fines, and loss of one's driver's license. As I advise all who have been arrested for a criminal matter, it is best to retain an expereinced criminal defense attorney to defend you with respect to the charges that he or she is faced with.
I recommend the same as to you. You should immediately consult with a criminal defense attorney about your situation and plan your line of defense to the charges. You need to be aware that the prosecution bears the burden of proving the charges against you beyond a reasonable doubt. Assistance from your treating physician concerning your medicaion would be helpful.
