You sue the photographer--you can bring a legal action seeking 1) an order requiring him or her to provide the pictures to you; or 2) if the pictures are not available (e.g. they were lost, ruined, etc.), that you receive monetary compensation. Unfortunately, you could only receive back the cost of the pictures/photography as compensation--the courts do not put a value on, or allow you to recover for, not having photographs of a special day.
