What do I doI bought a car from a private party anf he refuses to finish legal paper if work or give me my money back?

I purchased a used vehicle from a private party on Thursday. On Friday, I took it to get an oil change; they suggested a couple fluid flushes that I did. I asked them to raise the car up and give me a detailed list of what was wrong. As it turns out, the car is unrepairable due to it’s age and what all is wrong with it. I hadn’t yet received the smog certificate from the seller, and when I had told him I wanted my money back, he hung up the phone. I’ve looked the paperwork over, and his name isn’t on any of it. I haven’t signed anything or gone to DMV yet, as it is now the weekend. I want my money back and to be rid of the car but now the seller refuses to answer any calls. What do I do?

I would call the local police department and file a report to start with.  The District Attorney's Office may be interested as well.

I would contact the DMV and figure out who the registered owner is and contac them as well.  You should file a small claims lawsuit against the person who sold you the vehicle for breach of warranty (there is an implied warranty that the person selling the car owns it).

Best of luck.
