I answered an add from craigslist fro $1,500, Did the work and havn’t been paid.

I have a reciept from the General Contractor saying he owes $1385.40 + many E-mails saying he’s going to pay me, And 1 saying I’d get laughed out of court because I don’t have a license. But he knew that And I was wondering what I legal grounds I’d have in small claims court. I’ve had to sell my van and a few other hardships due to this non-payment over 2 months old.

I personally am not sure of the rules in CA regarding licensing for contract work but often times a license is not necessary depending on the work being completed. I also would advise that this is not an issue of having a license as he hired you so he is responsible for his employees and it is a matter of a debt being paid

you should contact a local collections attorney and have them pursue this matter. to do so usually they charge 20-30% as a fee of all monies collected. You also can decide to bring a suit in small claims court  and handle it yourself but an attorney may cause this guy to pay. You also should save all documentation and see an attorney with regard to pursuing a breach of contract claim against the GC seeing as he promised payment offered a job you accepted and upon completion he sent an email attempting to scare you away from collecting on a debt. It is worth seeing a lawyer to see if it is worth pursing. He may be liable to you for any losses such as your van due to his breach of the contract
