Arrest is not considered a bad act.  Are you the supervisor? If not, it is none of your business.  If you are the employer, did he sign authorization for you to conduct a criminal background check?  If not, you may be out of luck.

Sometimes conviction records are sealed and you may not have authority to obtain them and he doesn't have to reveal it.  So, consult the application he filed and consult your business attorney.
