How long does an insurance company have to give you the money from a casualty claim after they have admitted responsibilty on part of their client?

My daughter’s father was killed by a severely impaired driver 3 months ago. The kids insurance company admitted responsibility but has yet to draw up paperwork to complete the court hearing and give us the money. They admitted responsibility last January. My daughter’s fathers insurance company has already drawn up papers and I have signed them for their portion for the underinsured motorist.

Assuming there has been a written settlement of the personal injury claim with respect to your daughter's father, the time of paying the settlement check is ordinarily spelled out in the settlement agreement.

Meaning, the payment of the settlement check is usually conditioned upon so many days after the last person to sign the settlement agreement or upon so many days after some other factor set forth in the settlement agreement happening. I suggest that if there is a signed settlement agreement signed by all parties and their attorneys that you carefully read the agreement. Most likely your answer is within the document.
