In Masschusetts, the statute of limitations, or time within which to sue (which defines how long you'd have to bring an enforceable claim, since one you can no longer sue, you can no longer enforce the claim) is 3 years for both personal injury and for damage to personal property (like a car); therefore, you should have up to 3 years, but if you wait until near the end and the insurer or other driver will not pay you, you may run out of time to then file the lawsuit.
