Contrary to popular belief, not all employees need be treated the same or even equally. Discriminatory treatment is only illegal if it is based on race, religion, disability, age (over 40), gender, nationality, etc. Therefore, absent such discrimination, a company can set the conditions of employment much as it sees fit. Accordingly, unless some protection is afforded pursuant to the terms of a written employment contract or union agreement, there is no claim here.
