How to get my get married without a passport?

I was detain 2 years ago. After 3 months they let me out to work on my case. The immigration judge told me I can adjust my status by getting married to my fiancé and have her file for me. However, to get the marriage license I need my passport which is my only form of photo ID. I contacted INS and they said they lost it; I’m doubtful. What can I do?

Hello. You can always contact your Consulate in the U.S. You can provide some proof of identity (birth certificate, license, etc.) and they should be able to issue a new passport. However, every country has different requirements. In addition, you will need proof of your entry into the US for your immigration. You may need to file for a lost I-94 or Freedom of Information Act Request (FOIA) to get that.
