i purchased 1 queen bedroom set from a furniture company and they failed to deliver the furniture on time. after trying multiple ways to obtain my money the company has failed and ignored all my attempt to return my money 1250

You can sue the furniture company for breach of contract (breach of the sales contract).  Your damages (monetary compensation you are seeking in your lawsuit) would be the $1250 you paid.
You may be able to file your lawsuit in small claims court.  Upon prevailing in the case, you can also recover court costs which include the court filing fee and process server fee.
