I understand that you are trying to rationalize the length of time that the law states that the physical is valid (which is a law created for various reasons that may have nothing to do with anything) with current state law requirements for Doctors, but I do not think that you can get around the matter that way.  The law in Florida as I understand it is that you must keep a medical record for 5 years after the last date you saw the patient.  I would stick to that.
