Although I do not practice law in either the State of Indiana or Michigan, here are my initial impressions. First, if your daughter was sentenced to probation, presumably in Indiana, then there is likely a period of incarceration that may go into effect if she violates that probation. Of course, if her probation officer finds out about her new arrest, it is possible that that could be used as a basis to violate her probation and therefore she may risk incarceration. However, it is possible that since her new arrest has occurred in another state her probation officer may not find out about it. Nevertheless, this needs to be a concern. Obviously another concern is the consequences that she may/will face for her new pending case. Moreover, if she is convicted with respect to the pending case that could increase the likelihood that her probation officer would violate her. Therefore, due to the potential increasing consequences that your daughter may face, I strongly suggest that you consult with and/or retain a criminal defense attorney on her behalf who can evaluate the strength of the states case as well as any and all defenses that may be available, in addition to resolving both of these matters in the interest of minimizing the consequences that your daughter currently may face as a result of these two matters.
