What to do if I contracted a deep tissue staph infection,after arthroscopic shoulder surgery?

No skin infection, everything looked normal, took three visits to convince surgoen to test for infection. I have had 2 additional surgeries to clean out th infection 5 days in hospital, and 10days of home antibiotic IV. I signed a waiver before surgery, arbitration agreement. Do I have a case for arbitration to pay for medical bills , topping $30k?
