Employers can call and discuss your performance. Many employers try to do this in advance via a background check. However, many former employers decline to make comments because they do not want to face a potential lawsuit for libel, defamation, or interference with an employment agreement. So... the bottom line to your question is that "yes", your past employer can talk to your new employer--- but if he lies in that conversation or if he makes statements so as to interference with your new employment, you could have a potential cause of action against your former employer.
