Your attorney will just have to do the best he can.  Lawsuit strategy is an art, not a science;  I'm not a Texas lawyer and I don't have the facts of the case.  So I'm not going to second-guess your attorney.

A non-compliant witness at a deposition makes things difficult for everyone, and unnecessarily expensive.  Your attorney will have to decide whether to try to depose her, or do without it, and to a certain extent this might be a lose-lose choice.

Your stbx is being difficult, and losing her attorney is a real complication.  You will just have to be patient with the process and your attorney, I'm afraid.
